Bucharest, 13 October 2005. Yesterday, in the second day of the trial on the extradition request, the Swedish authorities acknowledged that none of the charges in the two arrest warrants - namely sexual act with a minor and persons traffic - are grounded.

The three witnesses heard (among which Madalina Dumitru), together with the evidence submitted in the file, proved to the Court that the charges brought by the Romanian authorities are false. Surprisingly, even the prosecutor in charge with the case admitted this. However she requests that Gregorian Bivolaru be extradited to Romania, a country candidate to the EU, where she believes that the judiciary would make the right decision and release him.

Mr. Bivolaru described to the Court the long series of abuses he underwent, and he stated his disbelief in a fair trial in Romania, where he expects to receive a disproportionate sentence, and even his life to be endangered.

Since form the judicial point of view the situation is clear, as the prosecutor herself admitted Mr. Gregorian Bivolaru is innocent, the decision to be reached by the High Court in the coming days will be a political one. The decision of the High Court can still be appealed before the Government. The decision regarding the request for the political asylum will be reached separately, in the coming weeks, by the Authority for Foreigners.
